Procedural Posture

Miscellaneous Application / Ruling on Application for Leave to Appeal Out of Time

  1. 1 Whether the applicants have provided sufficient reason for the delay in filing the appeal out of time.
  2. 2 Whether the delay in seeking leave to appeal is inordinate or excusable.
  3. 3 Whether the respondents will suffer prejudice if leave to appeal is granted.

Ratio Decidendi

The court found that although the applicants delayed by about two months in seeking leave to appeal, the delay was not inordinate and could be compensated by an award of costs. The explanation for the delay, namely the late supply of proceedings and judgment, was deemed reasonable in the circumstances. The court emphasized that the right to appeal should not be unnecessarily hindered, especially where the delay is not excessive and a plausible explanation is provided. In balancing the interests of justice and the prejudice to the respondent, the court exercised its discretion to grant leave to appeal out of time, subject to the applicants paying costs to the respondent.

Court Disposition

Application allowed; leave to appeal out of time granted, subject to payment of costs.

Orders

  • Leave to appeal is granted and Memorandum of Appeal to be filed and served within 7 days.
  • The applicants shall pay the respondent Kshs 10,000 as costs of the application within 30 days, in default the application and appeal to stand dismissed.
