Legal Issues
- 1 Whether the applicant's sentence for burglary should be revised.
- 2 Whether the favorable probation officer's report justifies revision of the custodial sentence.
Ratio Decidendi
The court declined to revise the applicant's custodial sentence for burglary despite a favorable probation officer's report. The judge reasoned that, although the report was positive, the prevalence of burglary in the region and the need to protect the public outweighed the applicant's mitigation. The court found no error, illegality, or impropriety in the original sentence and held that public interest and deterrence justified the continuation of the custodial sentence. Thus, the application for revision was dismissed and the applicant was ordered to serve the sentence to completion.
Court Disposition
application for revision declined; sentence to be served to completion
Orders
- The application for revision is declined.
- The offender to continue serving the sentence to completion.
