Both the High Court and the Kadhi’s Court have jurisdiction to determine matrimonial property disputes involving parties who profess the Islamic faith. Section 3 of the Matrimonial Property Act, 2013, grants Muslims the right to have their matrimonial property disputes governed by Islamic law but does not exclusively vest jurisdiction in the Kadhi’s Court. Article 170(5) of the Constitution limits the Kadhi’s Court’s jurisdiction to specific matters, but the High Court and subordinate courts retain concurrent jurisdiction, provided Islamic law is applied where appropriate.
