The court found that the defendants obtained leave to amend their defence and counterclaim on the representation that they would abandon the claim for the motor vehicles and substitute it with a claim for damages. However, the amended pleading retained and enhanced the claim for the motor vehicles and introduced a new claim for damages for conversion, contrary to the basis upon which leave was granted. The court held that parties and their counsel are required to be candid and not mislead the court.
