The Tribunal found that the tenancy in question is a controlled tenancy under the Landlord and Tenant (Hotels, Shops and Catering Establishments) Act Cap 301. The Landlord did not comply with the statutory requirement to issue a notice of termination in the prescribed form under Section 4 of the Act. However, the Tenant admitted to being in arrears and failing to pay rent as it fell due. The Tribunal held that while the Landlord is entitled to recover arrears and seek termination, the proper procedure must be followed.
