Ratio Decidendi

The court found that although the attachment of the applicant's motor vehicle for a relatively small outstanding sum (Kshs 2,450) was disproportionate, the applicant had not paid the full amount due, including the balance of taxed costs and auctioneer's fees. The attachment was therefore regular and lawful under the applicable rules. The applicant had a duty to clear the outstanding balance, however small, and retrieve its vehicle. The loss occasioned by the attachment could not be shifted to the respondent, as the applicant was the author of its own misfortune by failing to pay the full amount. Consequently, the application for compensation for loss of user was unmerited and dismissed.
