Procedural Posture

Stay Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the respondent has satisfied the conditions for grant of stay of execution pending appeal under Order 42 Rule 6 of the Civil Procedure Rules.
  2. 2 Whether the respondent has demonstrated sufficient cause and offered adequate security for the due performance of the judgment.
  3. 3 Whether the claimant should be allowed to enjoy the fruits of his judgment pending the intended appeal.

Ratio Decidendi

The court found that while the respondent had only filed a Notice of Appeal and not the substantive appeal, the right to appeal is protected by law and should not be frustrated by execution of the judgment. However, the claimant, having a valid judgment, should not be unduly prevented from enjoying its fruits. To balance these competing interests, the court held that the respondent must deposit the entire decretal sum in a joint interest earning account within 30 days as security. If the intended appeal is not filed and served within 45 days, the stay will lapse. This approach preserves the subject matter and ensures both parties' rights to justice are protected.

Court Disposition

Application for stay of execution allowed with conditions.

Orders

  • Judgment is stayed subject to the respondent depositing Ksh 624,000 in a joint interest earning account held in the names of both parties within 30 days.
  • If the intended appeal is not filed and served upon the claimant within 45 days, the order of stay shall lapse.
