Procedural Posture

Matrimonial Cause / Interlocutory Ruling on Admissibility of Documentary Evidence

  1. 1 Whether the defendant, as a party to the sale agreement, is competent to produce the document in court without calling the maker of the document.
  2. 2 Whether the maker (drawer) of the sale agreement must be called to testify as to its authenticity and execution.

Ratio Decidendi

The court held that the defendant, although a signatory to the sale agreement, was not the maker or drawer of the document. The agreement was drawn by the firm of Munene & Associates Advocates, and the signatures were witnessed by an advocate from that firm. The defendant could not answer questions on behalf of the advocate who drew the document. Therefore, in accordance with Section 76 of the Evidence Act, it was necessary for the drawer of the document to appear in court and confirm its authenticity and execution. The objection to the production of the document by the defendant was sustained, and the maker of the sale agreement was ordered to be called to testify.
