Ratio Decidendi

The court found that the orders appealed against were made in contempt proceedings, and under section 75(1) of the Civil Procedure Act and Order 43 of the Civil Procedure Rules, appeals from such orders do not lie as of right. The applicants did not seek or obtain leave of court before filing the appeal, which is a mandatory prerequisite for the court to assume jurisdiction. The court held that failure to obtain leave rendered the appeal incompetent and deprived the court of jurisdiction to entertain it. Consequently, the appeal was struck out for want of jurisdiction, as there was no competent appeal before the court.
