The defendant's failure to transfer the land, despite receiving full consideration, created a constructive trust in favour of the plaintiff. The court held that the plaintiff had proved his claim on a balance of probabilities and was entitled to a declaration of constructive trust, an order for transfer of the land, and, in default, execution by the Deputy Registrar. The court also awarded costs to the plaintiff.
