The claimant's memorandum of claim, filed on 27th August 2024, expressly stated her residence as Nairobi, and there was no evidence she had moved to Ahero in Kisumu County by that date. The court held that the suit ought to have been filed in Nairobi, not Kisumu. The claimant's subsequent affidavit did not establish a change of residence prior to filing.
