Procedural Posture

Civil Appeal / Application for Revival and Substitution After Abatement

  1. 1 Whether the applicant has shown sufficient cause to warrant revival of an abated appeal.
  2. 2 Whether the applicant, as personal representative, should be substituted in place of the deceased appellant.
  3. 3 Whether the delay in seeking revival and substitution is excusable under the circumstances.

Ratio Decidendi

The Court found that the applicant, as the widow and personal representative of the deceased appellant, was prevented by sufficient cause from acting in time due to lack of knowledge of the appeal and family disputes following her husband's death. The Court recognized that such circumstances are common and excusable within the social context. Applying Rule 102(3) of the Court of Appeal Rules, 2022, the Court held that justice required the revival of the appeal and the substitution of the applicant as appellant. The application was therefore allowed, and the applicant was substituted as the appellant in place of the deceased.

Court Disposition

Application allowed; appeal revived and applicant substituted as appellant; no order as to costs.
