The court held that striking out pleadings is a drastic measure reserved for hopeless cases, which was not the situation here. The court also determined that the plaintiff had complied with court orders regarding service of summons on the 2nd defendant by effecting substituted service through newspaper advertisements. Consequently, the application by the 3rd defendant lacked merit and was dismissed with costs.
