Ratio Decidendi

The court found that the Claimant's employment was terminated in August 2002 and the claim was filed on 25th March 2013, well beyond the six-year limitation period prescribed by Section 4(1)(a) of the Limitation of Actions Act. The Claimant did not obtain leave of the court to file out of time. Citing the Court of Appeal decision in Divecon Vs Simani, the court held it lacked jurisdiction to entertain the claim as it was statute barred. Consequently, the claim was struck out without consideration of the other grounds of objection.
