The court found that the plaintiff was entitled to enforcement of the consent order recorded on 17 January 2023, which granted him a specified portion of land. The respondent's failure to comply justified the court's intervention. Although the application sought orders against the Executive Officer rather than the Deputy Registrar, the court held that this was a technical defect that did not affect the substance of the relief sought. The court therefore ordered the Deputy Registrar, or a person authorised by him, to execute all necessary documents to effect the subdivision and transfer of the specified portion to the plaintiff, with the plaintiff bearing all associated costs.
