Ratio Decidendi

The court held that B. Mbai and Associates, being a different firm from Mbai and Kibuthu, was required to file a notice of change of advocates to be properly on record. The fact that Mr. Mbai was a partner in the previous firm did not exempt the new firm from this procedural requirement. Since the application for dismissal for want of prosecution was filed before the notice of change of advocates was filed, it was not properly before the court. The court therefore upheld the preliminary objection and struck out the application.
