Ratio Decidendi

The court held that Order 25 of the Civil Procedure Rules does not permit the withdrawal of a notice to withdraw or discontinue a suit or appeal. Once such a notice is filed and served, the proceedings are terminated and cannot be reinstated or resuscitated. The appellant's application to reinstate the appeal was therefore unmerited and misconceived, as the law does not provide for the revival of an appeal that has been withdrawn by notice. The court emphasized that the effect of the notice of withdrawal was to bring the appeal to an end, and there was no legal basis for setting aside or withdrawing the notice of withdrawal after it had taken effect.
