The court found that although the plaintiff's claim was for a liquidated sum and the application for summary judgment was unopposed, the procedural requirement of serving summons to enter appearance on the defendant had not been met. The plaintiff filed the suit and the application for summary judgment simultaneously, serving only the application and not the summons. Order 36 Rule 1 of the Civil Procedure Rules requires that the defendant must have appeared before summary judgment can be sought.
