The High Court found that it was functus officio in respect of the applicant's request for sentence review, as the issue of time spent in custody had already been determined by a court of concurrent jurisdiction (Kimaru J.) on appeal. The appellate court had expressly found that the trial court took into account the period spent in custody and had imposed a lenient sentence. The revisional jurisdiction of the High Court could not be invoked to re-examine or overturn a decision already rendered by a court of equal jurisdiction. Consequently, the application for review lacked merit and was dismissed.
