Ratio Decidendi

The High Court found that the respondents, having not obtained a grant of representation for the estate of Omar Khamis Baleth or the deceased, lacked locus standi to be sued or appear in court. The trial court therefore lacked jurisdiction to entertain the application for injunction filed against persons without locus standi. The proper determination of whether the matter should be referred to the Kadhi’s Court for succession and distribution can only be made at the hearing of the summons for revocation of grant. Consequently, the appeal was allowed, the impugned ruling set aside, and the application for injunction struck out for want of jurisdiction.
