Legal Issues
- 1 Whether the matter should be certified as urgent.
- 2 Whether the applicant is entitled to a certified copy of proceedings at this stage.
- 3 Whether the respondent should be served and given an opportunity to respond before further directions.
Ratio Decidendi
The court found that the application met the threshold for urgency and that it was necessary to provide the applicant with a certified copy of the proceedings to facilitate the criminal revision. The court further held that procedural fairness required the respondent to be served with the application and the court's orders, and to be given an opportunity to respond before further directions could be issued. Accordingly, the court certified the matter as urgent, directed provision of proceedings, ordered service on the respondent, set a deadline for the respondent's response, and scheduled a mention for directions.
Court Disposition
Application certified as urgent; interim procedural orders issued.
Orders
- This matter is certified as urgent.
- A certified copy of the proceedings to be availed untyped on June 28, 2023.
