There was no evidence that the respondent took any steps to obtain an extension of time by requesting certified copies of proceedings or notifying the applicant. The respondent did not provide any explanation for the delay or failure to comply with the rules. The application to strike out or deem the notice of appeal withdrawn was unopposed. The court found that the requirements of Rule 85(1) were met and that the notice of appeal was deemed withdrawn. The applicant was entitled to costs as provided by Rule 85(2).
