Ratio Decidendi

The court found that while the grievant may have breached banking regulations by paying out a dishonoured cheque after alterations, the Respondent failed to accord him procedural fairness as required under the Employment Act. The grievant was not given a proper hearing before termination. However, reinstatement was not available as more than three years had elapsed since dismissal, and payment for the period out of employment was not warranted. The court awarded compensation for unfair termination, limited to three months' salary and any dues calculated by the Respondent but uncollected by the grievant. No order as to costs was made.
