Although the claimant failed to take steps to prosecute the suit after filing and did not provide evidence of attempts to set the matter down for hearing, the respondent also contributed to the delay by filing its defence late and failing to file documents and witness statements necessary for trial. The court found that both parties were not ready for trial, and that dismissing the suit would not serve the interests of justice. Instead, the court directed both parties to file and exchange witness statements and documents within 21 days and to attend a pre-trial conference, thereby giving the matter an opportunity to proceed on its merits.
