Ratio Decidendi

The Plaintiff, as the undisputed registered proprietor of L.R. No. 209/11444, is entitled to exclusive possession. The Defendant, having agreed in writing to vacate the premises and received part payment, failed to comply with the agreement and continued to occupy and construct on the land without authority. Such occupation is wrongful and amounts to trespass. The court found the Defendant's actions to be unlawful and a violation of the Plaintiff's property rights. Accordingly, the Plaintiff is entitled to a permanent injunction restraining the Defendant from further construction, an order for vacant possession, eviction, nominal damages for trespass, and costs.
