Ratio Decidendi

The appellate court found that the trial court's award of general damages was not consistent with awards in comparable cases involving similar or lesser injuries. The trial court failed to cite or consider relevant authorities, resulting in an inordinately low award. The appellate court, guided by recent decisions and the nature of the appellant's injuries (fractures of the right femur, left ulna and radius, and a facial cut wound), determined that an appropriate award for general damages should be Kshs. 700,000, subject to the agreed contribution. The court set aside the trial court's award and substituted it accordingly, also awarding costs of the appeal to the appellant.
