The application for extension of time was filed promptly upon receipt of the judgment. On the issue of stay of execution, the court held that the applicant had not established that the respondent was unable to refund the decretal sum if the appeal succeeded, as the respondent provided evidence of property valued at Ksh. 3,200,000/- and a monthly salary of Ksh. 60,000/=.
