The court found that while the plaintiffs attributed the dismissal to their advocates' negligence, they were also partly to blame for failing to follow up on their case since 2012. However, in the interests of substantive justice and considering the undertaking by the current advocate to prosecute the matter without abusing the court process, the court exercised its discretion to reinstate the suit. The reinstatement was granted as a last chance, conditional upon the suit being heard within the calendar year 2018, failing which it would stand dismissed with costs unless otherwise ordered by the court. The costs of the application were ordered to be in the cause.
