The doctrine of exhaustion requires the applicant to pursue remedies in the subordinate court before seeking relief in the High Court. Furthermore, Section 10 of the Insurance (Motor Vehicles Third Party Risks) Act does not provide for a stay of execution against the insured by the third party, and the mere pendency of a declaratory suit does not entitle the applicant to a stay.
