The court found that the Aldai Division Lands Disputes Tribunal acted ultra vires in purporting to determine a dispute concerning ownership and title to land registered under the Registered Land Act (Cap 300). Only the High Court and Resident Magistrates Court have jurisdiction to entertain such matters. Although the court noted irregularities and possible bad faith in the applicant's acquisition of the title deed, it held that the Tribunal's lack of jurisdiction was dispositive. Consequently, the decision of the Tribunal and its adoption by the Magistrate's Court were quashed by an order of Certiorari.
