The court held that it lacked jurisdiction to grant the injunction sought because it was no longer exercising its appellate jurisdiction, having already delivered its judgment and the applicant having filed a notice of appeal to the Court of Appeal. Under Order 42 Rule 6(6) of the Civil Procedure Rules, the power to grant an injunction pending appeal is only available to the court when it is exercising appellate jurisdiction. Once a notice of appeal is filed, the jurisdiction to grant such an injunction shifts to the appellate court, in this case, the Court of Appeal, under Rule 5(2)(b) of the Court of Appeal Rules.
