The court found that at the time the consolidation order was made on 15th June 2007, the Defendant in HCCC No. 292 of 2007 had not instructed any advocate to represent it in that suit, and no advocate was on record for the Defendant. The record incorrectly reflected that the Defendant was represented and had consented to the consolidation. This constituted a material error on the face of the record, which denied the Defendant the opportunity to be represented and have its interests considered. The court held that this error justified review and variation of the consolidation order.
