In Originating Summons, it is permissible for one party to swear an affidavit on behalf of another, especially where the parties are co-purchasers as evidenced by the agreement. The absence of a written authority from the 3rd applicant did not render the proceedings defective. The preliminary objection was therefore dismissed as lacking merit.
