Ratio Decidendi

The court found that the two persons sought to be enjoined as interested parties were not parties to the original suit or the appeal and have no legal basis for joinder at the appellate stage. The dispute on appeal is strictly between the applicant and her deceased mother, the original respondent. If the applicant has a grievance against her sisters regarding the property, she must pursue a separate suit. The application for joinder was therefore dismissed. Additionally, the court noted that following the respondent's death, the appeal is stayed pending substitution of the deceased respondent within the statutory period, failing which the appeal will abate.
