Ratio Decidendi

The court found that the Claimant failed to prove that her contract was terminated due to injury or the filing of a compensation claim. The evidence showed that her employment was based on fixed term contracts, the last of which expired on 31st January 2016. There was no evidence of unfair termination or redundancy. However, the court held that the Claimant was entitled to pay in lieu of annual leave for the period worked, as the law mandates annual leave for employees who have worked for at least two months, regardless of contract type. The Respondent's failure to provide annual leave entitled the Claimant to compensation for 45 days of leave based on the minimum wage rate in her contract.
