Ratio Decidendi

The Court found that the applicant's claim was statute-barred under Section 90 of the Employment Act 2007, as it was filed more than three years after her dismissal. The limitation period for employment contract claims is mandatory and cannot be extended, regardless of the applicant's explanation for nonattendance or the alleged fault of her advocate. Even if the appeal were restored, it would inevitably be dismissed on limitation grounds. Therefore, the application for review and restoration of the appeal was dismissed as futile.
