Procedural Posture

Extension of Time Application / Ruling on Application for Extension of Time to Seek Leave to Appeal to the Supreme Court

  1. 1 Whether the applicants have provided sufficient explanation for the delay in filing the application for extension of time.
  2. 2 Whether the delay of approximately six months in bringing the application is inordinate and inexcusable.
  3. 3 Whether the applicants have demonstrated an arguable case warranting leave to appeal to the Supreme Court.

Ratio Decidendi

The Court found that the applicants failed to provide a satisfactory explanation for the inordinate delay of approximately six months in filing the application for extension of time to seek leave to appeal to the Supreme Court. Even accepting the applicants' claim that they only became aware of the judgment on 1st September 2014, there was still an unexplained period of delay between that date and the actual filing of the application. The Court reiterated that every aspect of delay must be explained, and in this case, the applicants did not meet that threshold. Consequently, the Court held that the application lacked merit and dismissed it with costs.

Court Disposition

Orders
