The court found that the applicant did not delay in bringing the application for stay, as she acted promptly upon learning of the judgment, which was delivered without notice. The court accepted that if part of the applicant's plot was taken or subdivided, it would be prejudicial and amount to substantial loss, thus satisfying the second condition for stay. The court therefore granted the stay of execution pending appeal, conditional upon the applicant depositing Kshs. 200,000 as security for costs within 60 days, failing which the stay would lapse automatically.
