The Court held that substitution of a deceased respondent in an appeal can only be effected if the person to be substituted has been granted legal representation over the deceased's estate. Neither the intended respondents nor the Public Trustee had obtained such a grant, and thus lacked the legal capacity to be substituted. The applicant's failure to exhibit a grant of representation rendered the application premature. The proper procedure would be for the applicant to move the High Court for a citation to compel the intended respondents or Public Trustee to obtain a limited grant for the purpose of the appeal.
