The Court of Appeal held that the Meru Central Land Disputes Tribunal acted in excess of its jurisdiction by purporting to determine ownership and award registered land parcels to the appellant. Section 3(1) of the Land Disputes Tribunals Act restricts the Tribunal's jurisdiction to disputes concerning boundaries, occupation, or trespass, and does not extend to matters of title or trust in registered land. The Tribunal's decision, which effectively cancelled and transferred registered titles, was therefore ultra vires. The High Court was correct in quashing the Tribunal's decision by certiorari.
