The court found that although the suit land was formally transferred to the 1st Defendant by the late Gabriel Kawala, the continued occupation of the Plaintiffs on the land during their father's lifetime indicated an intention for the 1st Defendant to hold the land in trust for the children of both houses. The evidence did not support the claim that the Plaintiffs had been provided for elsewhere, as plot number 2, Kyuluni, was never transferred to their late father and remained in the name of their grandfather.
