The applicants had obtained Letters of Administration and had issued a demand letter to the respondents, demonstrating knowledge of the facts giving rise to the cause of action. There was no evidence that any material fact was outside their knowledge, whether actual or constructive, as required by section 27(2) of the Limitation of Actions Act. The court held that the statutory requirements for extension of the limitation period had not been met and, following binding authority, dismissed the application for leave to file suit out of time.
