Ratio Decidendi

The court determined that it lacked jurisdiction to entertain the appeal because the Embu Provincial Appeals Committee had not rendered a decision. Under Section 8(9) of the Land Disputes Tribunals Act, an appeal to the High Court can only be made on a point of law from a decision of the Appeals Committee. Since no such decision existed, there was no valid appeal before the court. The court cited binding authority that jurisdiction is foundational and cannot be assumed; without it, the court must immediately cease proceedings. Entertaining the matter would amount to putting something on nothing, rendering any proceedings a nullity.
