Procedural Posture

Civil Appeal / Reference From Taxation Ruling

  1. 1 Whether the taxing officer erred in dismissing the Bill of Costs for lack of an order awarding costs.
  2. 2 Whether the Judge had jurisdiction to award costs upon withdrawal of suit.
  3. 3 Whether an order for costs made by a Judge should be complied with unless set aside.

Ratio Decidendi

The court found that the learned Judge had made an explicit order that the matter was withdrawn with costs to be agreed upon or taxed by the Deputy Registrar. This distinguished the present case from authorities where no such order existed or where the Judge lacked jurisdiction. Even if the Judge lacked jurisdiction, the order for costs stood unless set aside by review or appeal. The taxing officer therefore erred in dismissing the Bill of Costs on the basis that there was no order for costs. The Bill of Costs was reinstated and directed to be placed before the Deputy Registrar for taxation or other appropriate steps.

Court Disposition

Bill of Costs reinstated; costs of the application awarded to the applicant.

Orders

  • The Bill of Costs is reinstated and shall be placed before the Deputy Registrar for taxation or other appropriate steps.
  • The costs of the application dated 13th August 2018 are awarded to the applicant.
