Procedural Posture

Employment and Labour Relations Appeal / Judgment on Appeal

  1. 1 Whether the appeal was filed within the statutory period and is competent.
  2. 2 Whether the trial court violated the doctrine of functus officio by awarding costs after judgment without an application for review.
  3. 3 Whether the trial court erred in awarding costs to the respondent despite dismissal of the main claim.

Ratio Decidendi

The court found that the appeal was filed outside the statutory 30-day period required by both the Employment and Labour Relations Court (Procedure) Rules and section 79G of the Civil Procedure Act. The appellant sought certified copies of proceedings only after the time for filing the appeal had lapsed, and no sufficient cause was demonstrated for the delay. As a result, the appeal was fatally incompetent and could not be entertained. The court therefore struck out the appeal with costs, declining to consider the substantive grounds raised regarding functus officio and the award of costs by the lower court.

Court Disposition

Appeal struck out as incompetent for being filed out of time.

Orders

  • The appeal is struck out with costs to the respondent.
