Miscellaneous Application / Ruling on Notice of Motion for Consolidation and Entry of Judgment

  1. 1 Whether the court should consolidate the causes for purposes of entering judgment for taxed costs.
  2. 2 Whether judgment should be entered for the sum certified as costs and decrees issued accordingly.
  3. 3 Whether each taxation should be enforced separately or consolidated.

Ratio Decidendi

The court held that although some taxations between the parties have been concluded and others are pending, each taxation arises from a distinct suit and should be executed separately. The Advocates Remuneration Order is a self-contained code that does not provide for consolidation of taxations for the purpose of entering judgment. The application for consolidation and entry of judgment for the sum certified as costs was therefore dismissed, as each award must be enforced distinctly in accordance with the law.
