Procedural Posture

Miscellaneous Application / Ruling on Application for Leave to Tax Advocate Client Bill of Costs

  1. 1 Whether the applicant is entitled to leave to present for taxation an advocate-client bill of costs in relation to Kisumu High Court Civil Case No. 277 of 1998.
  2. 2 Whether the respondent instructed the applicant and is liable for professional fees.

Ratio Decidendi

The court found that the applicant, Behan & Okero, was entitled to present a bill of costs for taxation as there was sufficient evidence that the respondent had instructed the applicant, either directly or through acquiescence. The change of name from Joginder Singh Behan & Co to Behan & Okero was properly effected and communicated, and the respondent's conduct, including the signing of affidavits and notices of motion by its financial controller, demonstrated knowledge and acceptance of the applicant's representation. The respondent's objection based on lack of instructions was therefore without merit. The application was allowed as prayed.

Court Disposition
