Ratio Decidendi

The tribunal found that the applicant had admitted in both his affidavit and grounds in support of the application that the landlord had given the suit premises to another tenant prior to the filing of the complaint. As a result, there was no longer a landlord-tenant relationship between the parties at the material time. The tribunal held that the existence of such a relationship is a condition precedent for the application of Cap 301 and for the tribunal's jurisdiction. Since the relationship had ended, the tribunal lacked jurisdiction to hear and determine the dispute. Consequently, the complaint and application were dismissed for want of jurisdiction.
