Procedural Posture

Constitutional Petition / Judgment

  1. 1 Whether the mandatory death sentence for robbery with violence under Section 296(2) of the Penal Code is unconstitutional in light of the Supreme Court decision in Francis Karioko Muruatetu & Another vs. Republic [2017] eKLR.
  2. 2 Whether the Petitioners are entitled to resentencing and immediate release based on time served, remorse, and rehabilitation.

Ratio Decidendi

The court found that, following the Supreme Court's decision in Francis Karioko Muruatetu & Another vs. Republic [2017] eKLR, the mandatory death sentence for robbery with violence is unconstitutional. The court has jurisdiction to resentence the Petitioners. Considering the Petitioners' remorse, rehabilitation, and the 12 years already served, the court determined that a sentence of 12 years sufficiently serves the purposes of denunciation, rehabilitation, and deterrence. The death sentence was set aside and substituted with a 12-year term, which the Petitioners had already served, resulting in their immediate release unless otherwise lawfully held.

Court Disposition

Orders

  • The death sentence imposed upon the Petitioners is set aside.
  • The Petitioners are sentenced to a term of 12 years imprisonment, which they have already served.
