The court found that while the Claimant's conduct of ferrying unauthorised goods using the Respondent's truck constituted a valid reason for termination under Section 43 of the Employment Act, the Respondent failed to comply with the mandatory procedural fairness requirements of Section 41. The Claimant was not given adequate time to respond to the show cause letter or prepare for the disciplinary hearing, which was convened on the same day as the notice. This lack of due process rendered the dismissal unfair, entitling the Claimant to compensation and notice pay, but not to overtime, leave, or other claims that were either unproven or already settled.
